Terms of Service

These terms are the agreement between you and Artista ("we", "us"), the operator of artista.ai, for using the Artista website, the Studio, the design agent and everything around them (the "Service"). By creating an account or using the Service you agree to them. If you don't agree, don't use the Service. The Privacy Policy is part of these terms.

1. Your account

You sign in with a Google account. You must be at least 13 years old, or the age your country sets for consenting to online services, to use Artista, and at least 18 to buy credits. One person, one account: welcome credits and free allowances are per person, and creating accounts to collect them more than once is a breach of these terms. You are responsible for what happens under your account; tell us at once if you think someone else is using it.

2. Your designs

You own what you make. We claim no ownership of the designs you create with the agent, the assets you upload or the words you write. You are responsible for them: you must have the rights to anything you upload (reference images, fonts, SVGs) and to any text or brand you ask the agent to use.

What a design is. Designs are produced by an AI model working from your instructions. We don't promise that a design is unique, free of resemblance to other work, or protectable by copyright where you live; whether and how AI-assisted work can be protected is for you to assess for your use.

The license you give us. So we can run the Service, you grant us a worldwide, royalty-free license to host, store, copy, render into previews, display and transmit your content, and to let other users see and remix it to the extent your visibility settings allow. This license ends when you delete the content or your account, except for copies in backups for the retention period in the Privacy Policy, and for remixes others made while it was public.

Public designs can be remixed. Artista is a place to share and recombine. When you make a design public, you license it to everyone under the Creative Commons Attribution 4.0 International license: anyone may view, download, remix and reuse it, including commercially, as long as they credit you. A remix made on Artista records the design it came from. Making a design private again stops new copies and remixes; it doesn't undo those made while it was public. Private designs, and designs that live only inside your Studio, are licensed to nobody but us, as above.

Feedback. If you send us ideas about the Service, we may use them without owing you anything.

3. Credits and payments

Credits. The agent's work is paid in credits. A credit is a prepayment for model work on Artista. It has no cash value, can't be transferred, and is not a deposit, stored value or investment: it earns no interest and is not insured. New accounts receive welcome credits; you can buy more in packs on the Pricing page. The price in credits of the agent's work can change; the Pricing page shows roughly how many designs a pack buys, and the Studio shows your balance.

What you are charged. A run is charged as it goes, per model call. If a step fails because of us or our providers, you are not charged for it. If you stop a run, you pay for the work done up to that point, at our cost. If the model refuses a request, you are not charged for the refusal.

Purchases are final. Credits are consumed as the agent works and can't be returned, so purchases are non-refundable except where the law says otherwise. If you are a consumer in the EU or the UK, you have a 14-day right to withdraw from a purchase; by buying credits you ask us to make them available immediately, and you lose the right of withdrawal for the credits you have used. If a purchase went wrong — you were charged and the credits never arrived, or you were charged twice — email us and we will put it right.

Promotions. Welcome credits and other promotional credits are a gift, not a purchase: they may be limited, changed or withdrawn, and they may expire. If promotional credits carry an expiry, we show it where we show them.

Purchased credits don't expire while your account is open. If an account is inactive for 24 months, we may close it: we email the address on the account at least 30 days first, and credits left in a closed account are forfeited to the extent the law allows.

Payments are processed by Stripe under its own terms. Prices are in US dollars; taxes may be added where they apply. If a payment is disputed or reversed, we deduct the matching credits, which may leave a negative balance you must settle before using the agent again.

Your own API keys. The Studio can call model vendors directly from your browser with your own keys. Those calls are not charged in credits; you pay your vendor under your agreement with it, you are responsible for the keys and for the vendor's terms, and we never see your keys.

4. What is not allowed

Don't use Artista to make, upload or share content that is illegal, that infringes someone's rights, that sexualizes minors, that harasses or threatens people, or that deceives people about who made it or who it is from. Don't try to break the Service or others' use of it: no probing or circumventing security, no scraping or bulk downloading, no automated account creation, no interfering with the agent or the model providers, and no attempt to make a design run code or deceive people on another user's screen. Don't resell credits or access. Don't impersonate others, including through usernames.

We may remove content and suspend or close accounts that break these rules, without notice when the harm is serious. We don't review content before it is published; if you see something that shouldn't be here, tell us.

Copyright complaints. If you believe content on Artista infringes your copyright, email hello@artista.ai with the URL, a description of the work, your contact details and a statement that you believe in good faith that the use is not authorized. We remove infringing content and may close the accounts of repeat infringers.

5. The Service

Artista is young and changes often. We may add, change or remove features, and the models behind the agent change over time. We try to give notice of changes that reduce what the Service does.

If we ever discontinue the Service as a whole, we try to give at least 30 days' notice and a way to download your designs. Unused purchased credits are refunded where the law requires it; beyond that, credits are not a debt we owe you in cash.

6. Disclaimers and limits

The Service is provided as is and as available. We don't warrant that it will be uninterrupted or error-free, or that a design will fit a purpose. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, however caused. Our total liability for all claims about the Service in any 12-month period is limited to the amount you paid us in those 12 months, or US$100 if you paid nothing.

Some places don't allow some of these limits; there, they apply only as far as the law permits. Nothing here limits rights you have as a consumer that can't be waived.

You agree to indemnify us against claims arising from your content or from your breach of these terms.

7. Ending things

You can stop using Artista at any time and delete your account in Settings; the Privacy Policy says what happens to your data, and section 3 what happens to credits. We may suspend or close your account for a breach of these terms, for a legal requirement, or if we discontinue the Service. Sections 2 (the licenses granted while content was public), 3, 6 and 8 survive.

8. Disputes and law

If you have a problem, email us first; most things are fixed that way. These terms are governed by the law of the place where we are established, without regard to conflict-of-law rules, and disputes go to the courts there, unless the consumer law of your country gives you the right to your local courts and law.

9. Changes to these terms

We may change these terms. The date at the top says when they last changed; for a change that matters we tell you in the app or by email before it takes effect. Using the Service after that means you accept the new terms.
